How spousal support is calculated

Without dependent children

When there are no dependent children, the SSAG guidelines suggest a spousal support amount based on the income difference between the spouses and the length of the relationship.

The guideline range is 1.5% to 2% of the income difference for each year of the relationship, up to a maximum of 50%. Duration ranges from 0.5 to 1 year of support for each year of the relationship.

The Rule of 65 may apply: if the recipient’s age at separation plus the years of cohabitation equals 65 or more, the guidelines suggest support may be indefinite in duration.

With dependent children

When there are dependent children, child support is calculated first. Spousal support is then determined using Individual Net Disposable Income (INDI), which takes child support payments into account. The guidelines suggest a range where the lower-income spouse receives between 40% and 46% of the combined INDI.

This formula accounts for the tax impact of support payments, child-related benefits (like the Canada Child Benefit), and the child support obligation itself. The result is a range that reflects the economic reality of both households after separation.

Duration in with-children cases is typically tied to the younger child’s milestones (school age, end of high school) or the length of the marriage, whichever produces the longer duration.
