1. Acceptance of Terms

By accessing or using Amicably (“the Service”), operated by Amicably (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Amicably provides Canadian family support calculation tools, including child support and spousal support estimates, explanation trees, knowledge-grounded Q&A, and related features. The Service is intended for informational and educational purposes only.

We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Not Legal Advice

The Service does not provide legal advice. No lawyer-client relationship is created by your use of the Service. Calculations, explanations, and information provided are estimates based on publicly available guidelines and may not reflect your specific legal situation.

4. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the security of your account, including safeguarding access to the email address associated with your account. You are responsible for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service
  • Use the Service to harass, abuse, or harm another person, or to collect personal information about others without their consent
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated means (bots, scrapers, or similar) to access the Service without our prior written consent
  • Reproduce, duplicate, copy, sell, or resell any portion of the Service without our express written permission
  • Misrepresent the Service’s outputs as legal advice or professional counsel

7. Payments and Refunds

Certain features of the Service may require payment. All fees are stated in Canadian dollars (CAD) and are inclusive of applicable taxes unless stated otherwise. Fees are non-refundable except where required by applicable consumer protection law or as otherwise stated at the time of purchase.

We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed.

8. Intellectual Property

All content, design, software, algorithms, and other materials comprising the Service are owned by Amicably or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without prior written consent.

The calculations produced by the Service are generated for your personal use. You may share or print your own calculation results, but you may not present them as produced by a legal professional or as a substitute for legal advice.

9. Your Content and Data

You retain ownership of the data you input into the Service. By using the Service, you grant us a limited licence to use, process, and store your data solely for the purpose of providing and improving the Service. We will not use your data for any purpose other than as described in our Privacy Policy.

10. Third-Party Services

The Service relies on third-party providers for hosting, email delivery, AI processing, and authentication. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of any third-party service (such as Google for authentication) is subject to that provider’s own terms and privacy policies.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content or calculations will be accurate or complete. You acknowledge that family law is complex and jurisdiction-specific, and that the Service’s outputs are estimates only.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Amicably and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the amounts you have paid us in the twelve (12) months preceding the claim, or fifty Canadian dollars (CAD $50), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Amicably and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your reliance on the Service’s outputs for legal decisions.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, indemnification, and limitations of liability.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Province of British Columbia for the resolution of any disputes arising out of or relating to these Terms or the Service.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimers, constitute the entire agreement between you and Amicably regarding the Service and supersede all prior agreements and understandings, whether written or oral.

18. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
